TERMS & CONDITIONS

 

The Workshops at Howe Hill Farm are operated by Hessler Creative, LLC. These terms and conditions form the agreement between you and Hessler Creative, LLC. By booking a workshop you must sign this agreement and agree to abide and be bound by these terms and conditions. OVERVIEW

This Workshop Terms and Conditions Contract and Liability Waiver ("WCLW") between HESSLER CREATIVE, LLC (“HC") and the registered attendee (“Student”) sets forth the Workshop Description, Schedule, Fees and Liability Waiver.

WORKSHOP DESCRIPTION

The Workshops at Howe Hill Farm are primarily 2-day, creative focused workshops hosted online and onsite at the Howe Hill Farm Art Barn, located at 207 Howe Hill Road, Camden, Maine 04843. Some workshops materials will be provided, while other workshops will require students to bring their own equipment or tools. Please be sure to read through the course description to ensure you bring what you need.

CLASS MINIMUMS & CANCELLATIONS

The minimum class size is six students for the course to run. The maximum class size varies. If the minimum student number is not met within 30 days of the course it is HC’s discretion as to whether or not the course will run. If HC decides to cancel the course because of inadequate enrollment, HC will provide full refunds to registered students. Alternatively, students can transfer their tuition to a future Workshops at Howe Hill Farm course.

COVID-19 VACCINATION REQUIREMENTS

The safety of our students and teachers is top priority. Proof of vaccination from Covid-19 is required for all in-person and destination workshops. No exceptions. 

 

 

TUITION & FEES

The workshop cost covers tuition, materials fees and lunch (lunch included only for 2-day weekend courses). Full payment is required at booking. Reservations are not confirmed until payment is received.

REFUND POLICY

If you need to cancel, please notify us at least 30 days before the start of the workshop. At that time, we will refund your tuition, minus a $125 cancellation fee. Alternatively, you may transfer your full tuition amount to another HC workshop within 18 months (tuition can only be transferred to another Workshop at Howe Hill Farm workshop and not to any other institutions HC teaches at). Cancellations made  cancellations made after 30 days prior will result in forfeit of the full tuition amount or you may transfer to another workshop in the same calendar year. If you are traveling to come to a Workshop we recommend insuring your trip with Travelex insurance so your trip and tuition can be covered in the event of illness or other unforeseen circumstance.

PHOTOGRAPHY/VIDEO

Students are welcome to take photos of your experience and Workshop progress throughout the day. All student will need to get permission from their teacher and fellow students if they wish to post photos of other student and teacher work. HC may take photos and short videos throughout the day. These photos may be used for marketing purposes, including (but not limited to) use on websites, social media, blogs, advertising, news articles or more. It is the student’s responsibility to inform HC at the start of the Workshop if they do not wish to be in photos or videos. Failure to notify your instructor will mean your acceptance of these terms.

LIABILITY WAIVER

IN CONSIDERATION of being given the opportunity to participate in a HESSLER CREATIVE, LLC Workshop (hereinafter referred to as the “Workshop”), I, for myself, my personal representatives, assigns, heirs, and next of kin: ACKNOWLEDGE, agree and represent that I understand the nature of Workshop activities, and that I am qualified, in good health, and in proper physical condition to participate in such Activity.

 

I acknowledge and accept that as a participant in a Hessler Creative, LLC workshop; I take full responsibility for my behavior, well-being, and health throughout the booked event, which may involve a variety of activities, unfamiliar locations, and modes of locomotion, including but not limited to: climbing, hiking, running, or walking for a longer period of time than I am used to, physical exertion for which I may not be prepared, and weather extremes subject to sudden and unexpected change. I further acknowledge and accept that the workshop may involve traversing through snow and ice, walking through unfamiliar, narrow, unpaved and/or steep paths, bridges, roads, stairways and bushwhacking, as well as transportation in a variety of vehicles including but not limited to bicycles, cars, vans, motor coaches, or watercraft. I acknowledge that participation in this workshop has the potential to be a hazardous undertaking and may involve a great risk of physical injury. I knowingly and willfully accept all risks associated with this Hessler Creative, LLC workshop and agree to hold neither Hessler Creative, LLC, its instructors, officers, agents, representatives, employees or tour guides [hereafter referred to as “Staff”] liable in any way should any harm come to me, specifically including ground and water transportation.

 

I agree that if I suffer injury or illness, Hessler Creative, LLC or its Staff can arrange any medical treatment and emergency evacuation service as they deem necessary for my health and safety. Further, I agree that at all times during the workshop, I will abide by and comply with any additional instructions given by the instructor and other vendors of the workshop. I understand that non-compliance may result in my removal from the workshop.

 

I FULLY UNDERSTAND that:

(a) Workshops are conducted in both indoor and outdoor environments, and that accordingly I and my equipment may be exposed to dangers and hazards both natural and man-made; (b) Workshop activities involve risks and dangers of serious bodily injury (including permanent disability, paralysis and death), as well as risks and dangers to equipment; (c) these Risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the Workshop, the condition in which the Workshop takes place, or the negligence of the Releasee names below; (d) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time. I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Workshop.

 

I HEREBY RELEASE, discharge, and covenant not to sue HESSLER CREATIVE, LLC, their owners, directors, agents, officers, independent contractors, volunteers and employees, any sponsors, advertisers, and if applicable, owners and lessors of premises, on which the Workshop takes place, (each considered one of the Releasees herein) from all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise; and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees, from any litigation's expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of any such claim.

 

This Liability Waiver supersedes any other agreements or representations by or between the parties and is governed by the laws of the State of Maine and is intended to be interpreted as broadly as possible. I agree that exclusive jurisdiction and venue for any legal action shall be in the State of Maine Superior or District Court or the United States District Court for the State of Maine.

 

I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

 

By registering for a Hessler Creative, LLC Workshop (The Workshops at Howe Hill Farm) you are accepting these terms and conditions and agree to be bound by them.
